Introduction

 

Welcome to Growth CFO, a trading style of Aben Capital Ltd (“we”, “us”, “our”). By accessing or using our online platforms, services, AI Agents at ai.growthcfo.co.uk, and any related materials or tools (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use or access the Service.

1. Service Description

Our Service provides:

• Automated AI-assisted tools to review, analyse and comment on materials (e.g., pitch decks, financial models).

• Output generation (content drafts, summaries, insights) based on user input.

The Service is for general guidance and informational purposes only and is not a substitute for professional financial, legal, tax, investment, or other regulated advice.

Where a service includes 1-1 time with a human adviser, this time must be used within the month and unused time will not carry over from one month to the next.

2. AI-Agent Only Subscription Refund Guarantee

For clients subscribed exclusively to an AI-Agent Only Subscription Plan (the “AI-Agent Plan”), Growth CFO offers a satisfaction guarantee on the most recent monthly subscription fee. If the client is not fully satisfied with the AI-Agent Plan, the client may request a refund of one (1) month’s subscription fee, provided that: (a) the request is made in writing by email to team@growthcfo.co.uk; and (b) the client provides a brief explanation of the reason for their dissatisfaction.

This guarantee is limited strictly to one refund per customer and applies only to the most recent billing period. The guarantee does not apply to any other Growth CFO services, including but not limited to advisory services, consulting projects, fractional CFO engagements, or combined plans that include human advisory support. Growth CFO reserves the right to refuse refund claims that do not meet these conditions or which fall outside the permitted scope of this guarantee.

3. No Liability / No Reliance

(a) No warranties or representations

All output, recommendations, content, or materials generated by the Service (collectively, “Output”) are produced automatically using artificial intelligence and related technologies.

We make no representation or warranty, express or implied, as to the accuracy, reliability, fitness for purpose, completeness, or suitability of any Output.

(b) No liability

To the fullest extent permitted by law:

• We accept no liability for any loss, damage, cost, claim, or expense (whether direct, indirect, consequential, financial, or otherwise) arising out of or in connection with:

  • the use of, reliance upon, or inability to use the Service or its Output; or

  • any decision, investment, or action taken based on such Output.

• You agree that you use the Service entirely at your own risk.

• We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

(c) No professional advice

The Service and any associated Output do not constitute professional or regulated advice (including financial, legal, investment, or accounting advice).

You should seek independent professional advice before acting on any information generated by the Service.

4. User Content and Data Usage

You may upload, input, or otherwise provide text, documents, or other materials (“User Content”) for processing by the Service.

You retain ownership of your User Content, but by submitting it, you grant us a non-exclusive, royalty-free, worldwide licence to:

• process it to provide the Service, and

• store anonymised or aggregated data for analytics, model improvement, or product enhancement.

You represent and warrant that you own or have all necessary rights to the User Content you upload.

By using the Service, you acknowledge and agree that Growth CFO may collect, analyse, store, and use your interactions with the Service for the purposes described below.

 

This includes all forms of communication and content submitted by you or on your behalf, including but not limited to:

• Recorded calls or video sessions (Initial Consultations or otherwise);

• Emails, messages, files or documents shared with us;

• Input and output from Growth CFO AI Agents or other automated tools;

• Interactions with third-party workflow tools or interfaces connected to the Service;

• Any other communication or data exchanged in the course of using the Service.

(Collectively, “Client Interactions”).

 

Growth CFO may use these Client Interactions to develop, maintain, and improve its internal Knowledge Bank and the quality, accuracy, performance, and features of its AI Agents. Before any such use, Growth CFO will anonymise Client Interactions such that they no longer identify you or any natural person or organisation. Anonymisation will involve removing or irreversibly transforming names, contact details, identifiers, company-specific details, or other personally identifying information.

 

The anonymised data may be used for aggregated analysis, model training, system improvement, and internal research. We will never sell, publish, or disclose any Client Interactions in identifiable form to third parties.

 

Use of Client Interactions for internal Knowledge Bank training is conducted in accordance with applicable data protection laws, including UK GDPR, and the legal basis for this processing is Growth CFO’s legitimate interest in improving its Service while safeguarding user privacy through anonymisation.

 

If you wish to restrict specific materials from being included, you may submit a written request to team@growthcfo.co.uk; provided that such request does not apply to content already anonymised in a manner that makes individual identification impossible.

5. Data Protection and Privacy

Your use of the Service also is governed by our Privacy Policy, which explains how personal data is collected, used, stored, and protected. The Privacy Policy forms part of these Terms. We do not sell your personal data to third parties.

6. Account and Access

You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account.
We may suspend or terminate access at any time for misuse or violation of these Terms.

7. Intellectual Property

All intellectual property rights in the Service (including software, algorithms, and interface design) are and shall remain the property of Aben Capital Ltd or its licensors.

Except for the limited right to use the Service, no licence or right is granted to you.

8. Service Availability and Modifications

We may alter, suspend, or discontinue the Service at any time without notice.

We do not guarantee continuous or error-free operation.

9. Indemnity

You agree to indemnify, defend, and hold harmless [Your Company Name], its directors, officers, employees, and affiliates against any claims, losses, liabilities, or expenses arising from:

• your use of the Service or Output;

• your breach of these Terms; or

• your violation of applicable laws or third-party rights.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, and the courts of England shall have exclusive jurisdiction.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements or communications.
